Divorce Lawyers in Toronto & Mississauga
Experienced Legal Representation Through The Divorce Process
Divorce is the formal process required to end your marriage. Divorce is not required to end a relationship between two spouses; however, it is required if one or both spouses intend to re-marry. If two spouses agree on the issues arising from their divorce, it is likely that there will be no need to attend court and that the divorce can proceed on an uncontested basis.
A divorce can affect your rights and obligations on various issues such as parenting, support and property division, for example. Thus, if you are considering terminating a relationship with your spouse, it is important that you seek the advice of a reliable divorce lawyer who can describe all your possible options, and help you to determine your best legal course of action. At Nathens, Siegel LLP, we represent clients in all aspects of contested, uncontested and high net worth divorce proceedings throughout the GTA, including Toronto, and Mississauga.
Grounds For Divorce
Canadian courts may grant a divorce when there has been a breakdown of the marriage, and there is no reasonable prospect of reconciliation. A breakdown of the marriage can be established under the following circumstances:
- The spouses have been living separately and apart for a minimum of one year
- One of the spouses has committed adultery
- One spouse has treated the other with such physical or mental cruelty as to make continued cohabitation intolerable
The vast majority of divorces granted in Ontario are based on the one-year separation rule, which does not require fault by either spouse and often takes less time to complete than the grounds of adultery or cruelty.
