Negotiating Child Support Arrangements After Separation

In Ontario, the amount that a parent will be expected to pay in child support is calculated using the Child Support Guidelines. These guidelines take into consideration the payor parent's income, the residential arrangements of the children, and the number of children eligible for support. It is essential to receive complete information regarding the parent's income in order to determine a fair and accurate support amount.

The process involved with calculating child support can be quite complex for people who are not familiar with it. At Nathens, Siegel LLP, our child support lawyers have extensive experience representing clients in all aspects of establishing and enforcing child support, as well as to the variation of orders. We serve clients throughout the Greater Toronto Area, Ontario.

Factors That Impact Child Support

"Table support" is the basic amount of monthly support designed to cover a child's expenses, such as food, clothing and other basic supplies. A number of factors can impact the table support figure, including the residential arrangements. If the parents have a shared custody arrangement, for example, it can result in a reduction to the quantum of child support one parent receives/pays. In many cases, there may be special expenses for child care, such as medical care, education and extracurricular activities that the non-primary caregiver is required to pay in addition to table support. These are frequently referred to as Section 7 expenses.

Changed Circumstances That May Require Child
Support Variation

If there is a material change in circumstances that would have been found to exist when the initial order or agreement for support was made, parents have grounds to seek a variation or modification of the order or agreement. Our lawyers will conduct a thorough review of your case and advise you on your options. If you have grounds for a variation, we are prepared to represent you throughout the process.
